Maison.92 Club Loyalty Programme Terms and Conditions

1. Organiser and contact

1. The Maison.92 Club loyalty programme (the “Programme”) is organised and operated by LE POSSÉ sp. z o.o., with its registered office at Rynek Główny 34/15, 31-010 Kraków, Poland, entered in the Polish National Court Register under KRS 0001167385, tax identification number NIP 6762691721 and statistical number REGON 541469755 (the “Organiser”).
2. The Organiser can be contacted at care@leposse.com or by telephone at +48 532 88 66 11.
3. These Terms are made available free of charge in a form that permits them to be accessed, saved and reproduced.

2. Definitions

1. Account means the individual customer account in the Store associated with the Member’s email address.
2. Member means an individual who has joined the Programme in accordance with these Terms.
3. Pending Points means Points recorded for an Eligible Purchase but not yet available for redemption.
4. Available Points means Points released after the pending period and available for redemption.
5. Eligible Purchase means a paid purchase of eligible goods in the Store which has not been cancelled or returned.
6. Reward means a discount, code, benefit or other item made available in exchange for Points.
7. Store means leposse.com, including its language and market versions.
8. Tier means a membership level governed by the Maison.92 Club Tier Terms.

3. Joining and membership

1. Participation is voluntary and free of charge.
2. An individual with full legal capacity may join. A person with limited legal capacity may participate with the consent of their legal representative where such consent is required.
3. Membership is created when the customer signs in to or creates an Account, joins through the interface made available in the Store and accepts these Terms.
4. Each Member may hold one membership only. The Account may not be shared, and Rewards may not be resold.
5. Marketing consent is not a condition of membership. Any optional consent may be withdrawn at any time.
6. The membership agreement is concluded for an indefinite period. The Member may leave the Programme at any time under section 11.

4. Earning and release of Points

1. The earning rate is shown in the Store, on the Programme page, product page or Account before an Eligible Purchase. The rate shown for that purchase forms part of these Terms.
2. Points are calculated on the amount actually paid for eligible goods after discounts. Delivery charges, additional fees, gift card purchases, refunded amounts and items expressly excluded before checkout do not earn Points.
3. After payment, Points appear as Pending Points. They become Available Points 30 days after payment, provided the order has been fulfilled and has not been cancelled or returned.
4. If fulfilment, payment settlement or return identification occurs later, release may be postponed until the Organiser can confirm that the purchase remains eligible.
5. The Account displays Pending and Available Points, expected release dates and transaction history. The Organiser may correct an obvious error, technical fault, return, cancellation, chargeback or abuse.
6. Points are not money, electronic money or a financial instrument. They cannot be paid out, bear interest, be sold or transferred.
7. Available Points remain in the Account until redemption, lawful correction or termination of membership. A future expiry period may only be introduced by prior amendment and will not shorten the validity of Points earned before that amendment unless required by law.

5. Returns, cancellations and corrections

1. A return, withdrawal, cancellation, refund, chargeback or price reduction cancels or proportionally reduces the Points associated with that transaction.
2. If those Points have already been used, the Organiser may deduct them from the current or future balance. A negative Points balance is not a monetary debt, but must be cleared by future Points before another Reward is redeemed.
3. A Points adjustment does not restrict any mandatory consumer right.

6. Birthday Points and special actions

1. An active Member may receive 500 birthday Points once per calendar year if their date of birth has been correctly entered in the Account before the birthday and the bonus can be reliably assigned.
2. The bonus may not be obtained more than once through multiple Accounts. The Organiser may refuse or reverse a bonus obtained using inaccurate data or duplication.
3. Time-limited promotional earning opportunities may be offered under specific terms disclosed before participation.

7. Rewards and redemption

1. The current Rewards catalogue, Points cost, validity and restrictions are shown in the Store or Account before redemption.
2. Redemption is final when confirmed in the Store. The required Points are deducted and the Reward is assigned to the Account or issued as a code.
3. A Reward may be subject to a minimum order value, product exclusions, a validity period or restrictions on combining discounts where disclosed before redemption.
4. Rewards and unused portions cannot be exchanged for cash. If an order is cancelled for reasons attributable to the Organiser, Points used for the Reward will be restored where the nature of the Reward permits.
5. Reward availability may be limited. Removing a Reward from the catalogue does not invalidate a Reward properly issued earlier, subject to its stated validity and conditions.

8. Membership Tiers

1. The Programme includes Member, Prive and Icon Tiers. Qualification, maintenance and benefits are governed by the Maison.92 Club Tier Terms, which form an integral part of these Terms.
2. Returns, cancellations and adjustments may affect both Points and qualifying spend.

9. Electronic services and technical requirements

1. The Organiser provides electronic services necessary to operate membership, display balances and history, issue Rewards and administer Tiers.
2. Use requires an internet-connected device, a current browser supporting JavaScript and essential cookies, and an active email address.
3. Members must protect login credentials and report suspected unauthorised Account access without undue delay.
4. It is prohibited to submit unlawful content, bypass security, scrape data automatically, interfere with the Store or use the Programme contrary to law or its intended purpose.
5. The Organiser may carry out maintenance necessary for security, availability or development while taking reasonable steps to limit disruption.

10. Complaints

1. Complaints concerning Points, Rewards, Tiers or electronic services may be sent to care@leposse.com or to the Organiser’s registered office.
2. Where possible, the complaint should identify the Account, order or transaction, explain the issue and state the requested outcome. Missing information will not invalidate a complaint if it can still be examined.
3. The Organiser will respond on a durable medium within 14 days of receipt.
4. The complaint process does not restrict any right to an out-of-court dispute resolution procedure or to bring proceedings before a competent court.

11. Leaving, suspension and termination

1. A Member may leave the Programme at any time and without charge through the Account or by contacting the Organiser. Leaving the Programme does not necessarily delete the customer Account unless separately requested.
2. Leaving closes the membership and forfeits unused Points and Rewards once the instruction is completed. Points cannot be paid out.
3. The Organiser may temporarily suspend membership while investigating reasonably suspected fraud, Account takeover or a material breach, and will explain the reason unless prohibited by law or security considerations.
4. The Organiser may terminate membership immediately for a serious or repeated breach after warning the Member where the breach is capable of remedy.
5. The Organiser may discontinue the Programme for material legal, technical or business reasons on at least 30 days’ notice. Members will have at least 30 days to use Available Points unless continued operation is prohibited by law.

12. Personal data

1. The Organiser is the controller of Members’ personal data. Data are processed to conclude and perform the membership agreement, administer Points, Rewards and Tiers, prevent abuse, handle complaints and comply with law.
2. Further information about legal bases, recipients, retention and data-subject rights is available in the Privacy Policy.
3. Service messages required to operate the Programme are not marketing communications.

13. Amendments

1. The Organiser may amend these Terms for a material reason, including a change in law, authority decision, Programme functionality, security, technology, Rewards or operating model.
2. Members will receive notice on a durable medium at least 14 days before an amendment takes effect. A shorter period may apply where mandatory law, an authority decision or an urgent security threat requires it.
3. An amendment will not retrospectively remove Available Points or properly issued Rewards, unless required by law or necessary to correct abuse.
4. A Member who does not accept an amendment may leave the Programme without charge before it takes effect.

14. Final provisions

1. Polish law applies. This choice does not deprive a consumer of mandatory protection under the law of their habitual residence.
2. Matters not covered are governed by applicable law, including Polish civil, consumer, electronic-services and data-protection law.
3. Disputes will be heard by a court competent under applicable law.
4. If any provision is invalid or unenforceable, the remaining provisions continue in effect.
